NCAA says 3 former UM coaches misled probe

CORAL GABLES ? The NCAA believes former Miami assistant coaches Clint Hurtt, Aubrey Hill and Jorge Fernandez provided false or misleading information during the probe into the Hurricanes? athletic department.

The NCAA said all three violated ?principles of ethical conduct? as part of the notice of allegations served against the Hurricanes, according to a person who spoke to The Associated Press Wednesday on condition of anonymity because the allegations have not been released publicly.

Hurtt and Hill, who was an assistant coach at Florida in head coach Will Muschamp?s first season before stepping down last summer, were members of Miami?s football staff. Fernandez worked on the men?s basketball staff.

Several other coaches are named or referenced in the allegations, including Missouri basketball coach Frank Haith. But only Hurtt, Hill and Fernandez are facing the ethical-conduct charge, commonly known as NCAA Rule 10.1.

Hurtt is currently on the staff at Louisville. Hill is not working as a coach at this time, and Fernandez spent last season as an assistant at Marshall, resigning last May.

The notice of allegations was delivered to Miami on Tuesday, and the university is facing the charge that it had a ?lack of institutional control? ? one of the worst things the NCAA can levy against a member school. The charge revolves around how the school allegedly failed to monitor conduct of Nevin Shapiro, a rogue booster and convicted felon who provided cash, gifts and other items to players on the football and men?s basketball teams.

University President Donna Shalala said Tuesday night that the Hurricanes have suffered enough already through self-imposed sanctions. Through a university spokesman, she declined further comment Wednesday.

The NCAA said Hurtt and Hill committed the same violations, at least related to the ethical-conduct matter.

The NCAA alleged both provided meals, transportation and lodging to either recruits, current players, or both in either 2008 or 2009. Both were interviewed by the NCAA during the course of its probe and allegedly denied providing those extra benefits, statements the NCAA said were contradicted in each case by what players told them separately.

Hurtt also took a $2,500 personal loan from Shapiro, which was repaid. The NCAA also believes he sent about 40 impermissible text messages to recruits, which typically is a secondary, or minor, violation.

Fernandez, the NCAA alleged, ?knowingly provided extra benefits? in the form of an air ticket. The NCAA said Fernandez denied using air miles for the tickets for a men?s basketball player and a high school coach, despite evidence to the contrary.

In February 2012, Miami center Reggie Johnson was ruled ineligible by the school after an investigation revealed that members of his family accepted ?impermissible travel benefits? from a member of the school?s former coaching staff, without specifying Fernandez or anyone else by name. The university said Johnson was not aware of the benefits, personally accepted nothing and that his family had been told they were allowed.

Johnson was reinstated quickly last season, and remains a key part of this season?s team ? now ranked No. 2 in the nation and leading the Atlantic Coast Conference. The ongoing cloud of the scandal is not hurting the Hurricanes, basketball coach Jim Larranaga said Tuesday night.

?If it was overshadowing what we were doing, this room would not be packed,? Larranaga said after his team beat Virginia. ?We?re getting so much exposure. We can only focus on the things we have control over. We have nothing to do with the investigation.?

Several other former Miami coaches are named in the allegations as well, including one-time men?s basketball assistant Jake Morton, who the NCAA said, among other things, accepted ?supplemental income? of at least $6,000 from Shapiro. Morton is now on the staff at Western Kentucky.

Missouri coach Frank Haith is alleged of failing ?to promote an atmosphere for compliance,? a charge specific to how he handled things when Shapiro allegedly wanted money in exchange for not going public with accusations that he paid to help the Hurricanes recruit a player.

Some of the allegations are more than 10 years old, including a claim that Shapiro bought a suit for former Miami star running back Willis McGahee to wear to the Heisman Trophy ceremony in 2002.

Other allegations include that he paid for dinners at Benihana, televisions, sneakers, Miami Heat tickets, bowling parties, one player?s engagement ring, a used washer-dryer set for current New England Patriots lineman Vince Wilfork, and that he directed his girlfriend to give two former Hurricanes no-show jobs for a couple of months.

Allen retirement opens Europe command slot

WASHINGTON (AP) ? President Barack Obama is looking for a new candidate to lead American and allied forces in Europe after his first choice, Marine Gen. John Allen, bowed out Tuesday and announced his intention to retire for what he called personal reasons.

The move further clouds the picture for Obama as he repositions key figures on his national security team and in key military leadership roles. The White House is fighting for Senate confirmation of Chuck Hagel as defense secretary; a confirmation vote was stalled last week by Republicans but is expected to happen next week.

Obama also is switching commanders at Central Command, which is responsible for U.S. military operations throughout the greater Middle East, and Africa Command.

After meeting with Allen at the White House, the president issued a brief statement praising Allen's service. He called the 57-year-old Allen "one of America's finest military leaders, a true patriot, and a man I have come to respect greatly."

Allen appeared to be a shoo-in as the next top commander of allied forces in Europe. Obama nominated him last Oct. 10, but in November, Defense Secretary Leon Panetta stunned many by announcing that Allen was being investigated for potentially inappropriate email exchanges with a Florida socialite, Jill Kelley. Panetta put Allen's nomination on hold.

Last month, shortly before Allen completed a 19-month tour as the top U.S. commander in Afghanistan, the Pentagon announced that Allen had been cleared of any wrongdoing and the White House said it was prepared to re-nominate him for the Europe job.

Even so, it was not clear that Allen would choose to go ahead with a Senate confirmation hearing, given the nature of the email probe.

Allen is held in high regard by Democrats and Republicans on the Senate Armed Services Committee, which would have voted on his appointment, and he was expected to win full Senate confirmation. It came as no surprise to many on Capitol Hill when Allen was cleared of wrongdoing in the email probe, which several lawmakers had indicated was not as troublesome as some had initially suggested. The actual emails between Allen and Kelley were never made public.

One of Hagel's biggest detractors, Sen. Lindsey Graham, R-S.C., showered Allen with praise Tuesday, saying the nation owes him a great debt and "his leadership in the future will be missed."

An Iraq war veteran with a reputation as an astute strategist, Allen took over in Kabul in July 2011, succeeding Gen. David Petraeus, who quit to become CIA director. Allen relinquished command Feb. 10 to a fellow Marine general, Joseph Dunford.

Allen said retiring from the military was "the only choice I could make." Although he did not explain his reasons in detail, he said "my primary concern is for the health of my wife, who had sacrificed so much for so long." He served 38 years in the Marine Corps.

In retiring, Allen passed up Obama's offer to promote him to the Europe job, which is one of the more prestigious jobs in the military. It carries the dual responsibilities of commanding NATO troops from allied headquarters in Belgium and heading the U.S. European Command, a separate organization based in Germany.

The U.S. has about 80,000 troops based in Europe.

It's unclear who Obama will nominate for that job. The current commander, Navy Adm. James Stavridis, had planned to leave last year, but was asked to stay on until Allen could take over. He is expected to remain until a successor is confirmed.

Army Gen. Carter Ham might have been a logical choice, in part because he previously served as commander of all U.S. Army forces in Europe. But he is scheduled to retire this year. He currently serves as commander of U.S. Africa Command.

In a written statement Tuesday, Allen he wants to focus on helping his wife, Kathy, cope with health issues. He was not specific about her ailments, but The Washington Post quoted Allen on Monday as saying that his wife suffers from a combination of chronic health issues that include an autoimmune disorder.

"The reasons for my decision are personal," Allen said in his statement. "I did not come to it lightly or quickly, but given the considerations behind it, I recognized in the end it was the only choice I could make.

"While I won't go into the details, my primary concern is for the health of my wife, who has sacrificed so much for so long. For more than 35 years, my beloved Kathy has devotedly stood beside me and enabled me to serve my country.

"It is profoundly sobering to consider how much of that time I have spent away from her and our two precious daughters. It is now my turn to stand beside them, to be there for them when they need me most," he said.

Allen told the Post that his decision to retire was not influenced by the investigation of his email exchanges with Kelley, who was tied to the sex scandal that forced Petraeus to step down last fall as CIA director. Allen told the newspaper, however, that publicity surrounding the email probe "took a toll" on his wife.

Word began to spread last week that Allen was having second thoughts about taking the Europe job. When asked at a news conference last week about Allen's status, Panetta told reporters that the general had been "under a tremendous amount of pressure," including difficult recommendations on the future course of U.S. military involvement in Afghanistan. Panetta said he advised Allen to take time to weigh his options, consult with his family, and decide his future.

In a statement following Obama's announcement Tuesday, Panetta heaped praise on Allen.

"He has earned the lasting thanks of this nation for carrying the heavy burden of leadership with utmost professionalism and courage," Panetta said. "I wish him and his entire family all the best in the next chapter of their lives."

Connecticut shooter wanted to top Norway death toll: CBS

(Reuters) - The man who shot dead 20 children and six adults at a Connecticut elementary school wanted to kill more people than the 77 slain by a Norwegian man in a 2011 rampage, CBS News reported on Monday, citing unnamed law enforcement sources.

A Connecticut state police spokesman dismissed the report as inaccurate speculation.

Adam Lanza, 20, who killed himself as police closed in on him at Sandy Hook Elementary School in Newtown, Connecticut, on December 14, saw himself in direct competition with Anders Behring Breivik, who killed 77 people in a bombing and shooting attack in Norway on July 22, 2011, CBS said. Breivik surrendered to police.

Citing two officials briefed on the Newtown investigation, CBS said Lanza targeted the elementary school because he saw it as the "easiest target" with the "largest cluster of people."

The report did not say how the investigators learned of Lanza's desire to compete with Breivik.

Lanza was also motivated by violent videogames and had spent numerous hours playing games and working on his computer shooting skills in a private gaming room with blacked out windows, CBS said. Investigators recovered a large number of games from the basement, the report said.

Evidence shows that in his mind, Lanza was likely acting out the fantasies of a videogame during his shooting spree with each death amounting to some kind of "score," CBS said.

Lanza killed 20 schoolchildren aged 6 and 7 plus six adults who worked at the school, shocking the United States and leading President Barack Obama to propose new gun control legislation.

Authorities have not publicly spoken of his motive.

"All of it is speculation. There is no basis to the CBS story. We have not established a motive. It's inaccurate," Connecticut State Police Lieutenant Paul Vance said in a statement read on CNN.

Breivik, a self-styled warrior against Muslim immigration, killed eight people by bombing the Oslo government headquarters and then shot dead 69 people at the ruling party's summer youth camp.

A Norwegian judge last year sentenced Breivik to the maximum 21 years in prison, though his release can be put off indefinitely should he deemed a threat to society.

Gen. John Allen declines top NATO post

Marine Gen. John Allen, former commander of allied forces in Afghanistan, will retire from the military to care for his ailing wife. President Barack Obama, who had nominated Allen to head NATO, met with the departing officer Tuesday and accepted his request to leave the armed forces, the White House said.

Obama had nominated Allen to be Supreme Allied Commander Europe and Commander of the U.S. European Command in October 2012. But that move went on hold while the Pentagon?s inspector general looked into Allen's email contacts with a Tampa socialite linked to the scandal that led to CIA director David Petraeus?s resignation. Allen was cleared of any wrongdoing, and his confirmation was unlikely to run into trouble in the Senate.

?Today, I met with General John Allen and accepted his request to retire from the military so that he can address health issues within his family,? Obama said in a written statement.

?I told General Allen that he has my deep, personal appreciation for his extraordinary service over the last 19 months in Afghanistan, as well as his decades of service in the United States Marine Corps,? the president said.

Obama praised Allen for overseeing ?the significant growth? in Afghan security forces, continued ?degradation? of al-Qaida and its Islamist allies, and the shift of security responsibility to Afghanistan?s military and police?a linchpin of the president?s NATO-backed plan to pull American forces out by the end of 2014.

?He worked tirelessly to strengthen our coalition through his leadership of the International Security Assistance Force (ISAF), and to improve our relations with the Afghan government,? Obama said.

?Above all, he cares deeply for the men and women in uniform who serve our nation?as well as their families?and I am grateful for the sacrifices made by his family in supporting him during his service. John Allen is one of America?s finest military leaders, a true patriot, and a man I have come to respect greatly,? the president said.

He added, ?I wish him and his family the very best as they begin this new chapter, and we will carry forward the extraordinary work that General Allen led in Afghanistan."

Allen?s wife, Kathy, is very ill with a combination of chronic health issues that include an autoimmune disorder, the Washington Post reported.
